April 13, 2008 Secret Iraqi Deal Shows Problems in Arms Orders
By SOLOMON MOORE BAGHDAD — An $833 million Iraqi arms deal secretly negotiated with Serbia has underscored Iraq’s continuing problems equipping its armed forces, a process that has long been plagued by corruption and inefficiency.
The deal was struck in September without competitive bidding and it sidestepped anticorruption safeguards, including the approval of senior uniformed Iraqi Army officers and an Iraqi contract approval committee. Instead, it was negotiated by a delegation of 22 high-ranking Iraqi officials, without the knowledge of American commanders or many senior Iraqi leaders.
The deal drew enough criticism that Iraqi officials later limited the purchase to $236 million. And much of that equipment, American commanders said, turned out to be either shoddy or inappropriate for the military’s mission.
An anatomy of the purchase highlights how the Iraqi Army’s administrative abilities — already hampered by sectarian rifts and corruption — are woefully underdeveloped, hindering it in procuring weapons and other essentials in a systematic way. It also shows how an American procurement process set up to help foreign countries navigate the complexity of buying weapons was too slow and unwieldy for wartime needs like Iraq’s, prompting the Iraqis to strike out on their own.
Such weaknesses mean that five years after the American invasion, the 170,000-strong Iraqi military remains under-equipped, spottily supplied and largely reliant on the United States for such basics as communications equipment, weapons and ammunition, raising fresh questions about the Iraqi military’s ability to stand on its own.
Iraq’s defense minister, Abdul Qadir, defended the arms deal, saying he had followed proper contracting protocols and had informed Prime Minister Nuri Kamal al-Maliki every step of the way.
Nonetheless, American commanders and some Iraqi officials criticized the Serbian arms purchase. Closer monitoring of weapons deals has been a delicate subject since a series of tainted arms purchases totaling $1.3 billion in Iraqi government funds in 2004 and 2005. Lacking electronic banking systems at the time, Iraqi officials paid for second-rate or nonexistent weapons and equipment in cash, using middlemen to ferry duffle bags stuffed with bricks of $100 bills.
That episode brought down the previous defense minister, Hazam Shalan, now a fugitive, and tarnished the reputation of the interim prime minister, Iyad Allawi. American and Iraqi officials said that the loss of so much money and time caused critical delays in the development of the Iraqi Army.
Those with knowledge of the Serbian arms deal said they knew of no specific crimes, but warned that with so little transparency and such poor oversight, problems were likely to emerge, as they did with the 2004 deal.
The Serbian deal called for the purchase of a large number of helicopters, planes, armored personnel carriers, mortar systems, machine guns, body armor, military uniforms and other equipment. It was largely negotiated by Mr. Qadir and the planning minister, Ali Glahil Baban. In response to the criticism, Mr. Qadir said he “froze” purchases of the personnel carriers and some aircraft, reducing the final contract price to $236 million. The deal was signed in March, American military officials said.
“We just want to have a mix of procedures for contracts so we can expedite our acquisition,” Mr. Qadir said, adding that “American timelines for delivery were too far away.”
Despite the criticism, some American advisers said the deal was an essential part of the Iraqi military’s learning curve and a test of the American military’s capacity to balance guidance and restraint.
“We can be very overbearing as a nation, and part of this task is a feel for this task,” said Lt. Gen. James M. Dubik, the commander of the Multinational Security Transition Command and the head of America’s security advisory mission in Iraq. “How do I impose myself enough to keep things going but back off enough to let development occur? There is an art to this.”
Diverging Accounts
American military officials and the Iraqi authorities alike point to the Pentagon’s little-known Foreign Military Sales program as the reason the Serbian arms deal was pursued in the first place. After that, however, their versions of events diverge sharply.
Under the sales program, used by more than 100 allied nations, Pentagon officials serve as intermediaries for government-to-government defense procurements, handling administrative issues, logistics, delivery, maintenance and training. Clients sometimes get the benefit of American economies of scale, American expertise regarding weapons systems and quality control and built-in transparency and corruption safeguards. Defense contractors also benefit to some extent, because the program often channels clients to American companies that produce arms and other equipment.
American officials hoped the program would help Iraq spend more of its own money on defense. Last year, for the first time, Iraqi military expenditures of $7.5 billion surpassed the $5.5 billion in American financing for Iraq’s military. But the program is intended for peacetime, and with protocols spanning hundreds of pages, it is built more for transparency and standardization than for speed.
Beginning in late 2006, the Iraqi government deposited $2.6 billion in an account for Foreign Military Sales procurements. But by September 2007, less than $200 million worth of badly needed equipment had been delivered, and many of those items were stockpiled because of poor distribution and accountability systems. And that, the officials pointed out, was during one of the most violent periods on record.
“The problem with F.M.S. is that it didn’t deliver on time,” a senior Iraqi official said, “and this was used by some in government to say, ‘Look, this is deliberate. The U.S. is trying to keep us unarmed so that we’ll always be in need of the Americans.’ ”
General Dubik, in an interview in his office in the Green Zone, acknowledged, “There was an issue of credibility in our system.”
But there were problems on the Iraqi side as well, American military officers said. A bureaucracy used to functioning under a command economy during the reign of Saddam Hussein had little use for formal procurement protocols and was unaccustomed to such basic practices as writing detailed specifications.
“I mean literally, the Iraqis had some letters of request that said, ‘We want to buy 1,000 trucks,’ ” said Joe Benkert, an assistant defense secretary for global affairs who manages the Foreign Military Sales program.
Some critics, all of them high-ranking Iraqi and American military officials, made the more serious charge that senior Iraqi officials intentionally obstructed American-sponsored procurements because they feared the sales program would prevent them from siphoning off a share of the money. But they offered no independent corroboration.
“The defense minister is playing games,” said an official with Iraq’s Defense Ministry who spoke out because of his concern about corruption, but also spoke on condition of anonymity for fear of reprisals. “He is stopping F.M.S.,” the official said. “Contracts just sat on his desk waiting for approval for six or seven months sometimes.”
American procurement experts were so mystified by some of the delays that they set up a new office to track procurements and found that many of the delays led straight back to Mr. Qadir’s desk. Mr. Qadir denied delaying contracts or making money from them.
After months of delays and an overhaul of the Pentagon procurement bureaucracy, the program increased the value of its delivered equipment to $1 billion by this February. But in the absence of a comprehensive distribution and inventory system in Iraq, much of that equipment remains locked in Iraqi storehouses, American officials said.
Mr. Qadir, who made headlines during a January visit to the United States, when he said Iraq could not take full military responsibility for itself until 2018, blamed the slowness of the Foreign Military Sales program for his decision to deal directly with Serbia. “Foreign Military Sales is a system built to provide weapons systems to a national force in a peaceful time,” he said.
A Deal in the Dark
In an interview in February in his office, Mr. Qadir, a Sunni Arab native of Ramadi, confirmed that the original Serbian deal “exceeded $800 million.”
“The thing is, we did not limit ourselves to any fixed number or fixed price,” he said.
But critics say the deal circumvented fragile anticorruption safeguards. Indeed, at Mr. Qadir’s urging Mr. Maliki abolished the National Contracts Committee, a mandatory review agency for all government purchases of more than $50 million.
Mr. Maliki also overrode the nation’s Supreme Economic Committee after it expressed concerns that the Serbian deal lacked guarantees of service from the Serbian government.
The deal was also supported by Iraq’s Office of the Commander in Chief, a shadowy group of Shiite advisers to Mr. Maliki that American officials accused last year of leading a purge of Sunni Iraqi Army commanders who had cracked down on Shiite militia leaders.
The same group, which rejected suggestions that it bring in Western advisers, has marginalized senior uniformed officers charged with procurement decisions and kept American officials in the dark about Iraqi financing of arms deals, according to high-ranking American officials familiar with its workings.
“It struck me as bizarre,” said a Western official with knowledge of the security ministries, who spoke on condition of anonymity because he did not want to be seen as criticizing people he was advising. “You can only explain it in two ways: a desire to avoid oversight and a desire to offer opportunities for graft and corruption.”
A high-ranking Iraqi government official who spoke on condition of anonymity, for fear of reprisals against him and others in his office, said, “We have no confidence in the Iraqi contracting process.”
“I heard about it out of the blue, that the minister of defense took a delegation to Serbia and came back and said that he had signed deals with the Serbian prime minister,” the official said. “Why Serbia? Why not Ukraine? Why not Russia? We just don’t know.”
American military officials did persuade Mr. Qadir to cancel the $200 million purchase of 30 to 40 French-made Puma helicopters, arguing that they were unsuited to Iraq’s harsh climate. The minister also decided against buying armored personnel carriers and Gazelle helicopters.
American and Iraqi military officers also questioned the wisdom of purchasing tens of millions of dollars of nonmilitary crowd control gear — batons, stun guns and plexiglass shields — usually used by police forces, and $76 million worth of mortar systems, which are too imprecise to use against guerrillas. The minister said he still intended to buy the riot control equipment, to handle crowds of Shiite pilgrims, and mortar systems, because the insurgents have them.
Critics of the deal also complained that the arms agreement thwarted the standardization of the Iraqi Army’s hodgepodge of war matériel, which includes firearms from the United States, China, the Balkans, Pakistan and Russia; 150 types of land vehicles; and a United Nations panoply of aircraft.

April 2, 2008 OP-ED CONTRIBUTOR A Battalion’s Worth of Good Ideas
By JOHN A. NAGL THE “surge” of American forces in Iraq, coupled with an adherence to classic counterinsurgency principles, has gone a long way toward improving security there. Ultimately, though, success must be handled by the Iraqis themselves. And the key to success — in Afghanistan as well — rests largely with a small group of American military advisers who live and fight alongside foreign forces.
In a speech last fall to the Association of the United States Army, Defense Secretary Robert M. Gates argued that the most important military component of what the Pentagon calls the “long war” against radical extremists will not be the fighting we do ourselves but how we “empower our partners to defend and govern their own countries.” This is something we know how to do, though we often move too slowly in shifting the burden of fighting from our own troops to those we are trying to help.
Based on American experiences in Korea, Vietnam, El Salvador and now in Iraq and Afghanistan, an advisory strategy can help the Iraqi Army and security forces beat Al Qaeda and protect their country. (Obviously, these are my personal views, and do not represent those of the Army.) However, doing so will require America’s ground forces to provide at least 20,000 combat advisers for the duration of the wars in Iraq and Afghanistan — men and women specially equipped and trained to help foreign forces bear a greater share of the combat load.
Unfortunately, America’s military did not have the advisory capacity it should have had after major combat operations ceased. The first attempt to create a new Iraqi Army was farmed out to private contractors. When that effort failed, and it became clear that the assistance needed to help the fledgling Iraqi Army far exceeded the capability of the Army’s Special Forces, regular Army troops were called on to fill the gap. Given their lack of training, these soldiers did remarkably well, but it was always a stopgap measure.
Fortunately, the advisory effort has been improved in the last couple of years. No longer do our troops receive training of varying quality conducted at different Army posts; since 2006, all Army, Navy and Air Force adviser training has been centralized at Fort Riley, Kan., under the Army’s First Infantry Division, where I lead one of the training battalions engaged in this effort.
Graduates deploy in 10- to 16-person teams that embed with Iraqi and Afghan security forces, assist in their training and accompany them into combat. Not only does this give those foreign troops exposure to our military tactics, it also provides a critical link to American artillery, air support and logistics during operations. Still, we have not seen the urgency the mission requires.
Doctrine — a standard enumeration of the purpose of a military organization and how it will accomplish its goals — is still nonexistent for the adviser mission. Organization is inconsistent, for example, with most Afghanistan teams consisting of 16 soldiers with no medic, while most Iraq teams contain 11 soldiers, including a medic. The fact is, both types of teams are too small for the tasks they have been assigned, and many consequently have been augmented on the ground by regular troops on an ad hoc basis.
This is simply because not enough advisers are being produced — just 5,000 per year. We are going to need ever more experienced, trained advisers as the size and complexity of the Iraqi and Afghan police forces and armies grow and as the combat burden increasingly shifts to them.
Part of the problem is institutional. The United States military’s ability in battle is unmatched, but we have a spotty history in terms of helping allies fight for themselves. Advisers who live and fight with a struggling “poor cousin” local army often do their dangerous and sometimes frustrating work out of sight of the brass, and it can be a career-killer for ambitious young officers.
In Vietnam, the advisory effort got off to a slow start and was too often neglected in favor of United States-only operations. Only after Washington committed in 1969 to so-called Vietnamization at the direction of President Richard M. Nixon did advisers get the resources and recognition they deserved, and by then it was too late. In the words of an (anonymous) Army officer who served in that war, “Our military institution seems to be prevented by its own doctrinal rigidity from understanding the nature of this war and from making the necessary modifications to apply its power more intelligently, more economically and, above all, more relevantly.”
Too much of that statement still rings true today. In the long term, we need to institutionalize our ability to field advisers and provide effective military assistance to allies. As it stands now, the troops we train at Fort Riley do their tour and are then moved back into conventional roles, while the embedded training teams are demobilized. This is as senseless as if in World War II we had decided that the First Infantry Division, which had gone ashore in North Africa and Sicily, was to be disbanded and replaced on D-Day with a division that had no experience landing on hostile ground. What we need, even after the Iraq and Afghanistan missions have ended, is a standing advisory corps of about 20,000 troops that can deploy wherever in the world we need to get our allies up to speed.
Ultimately, a successful shift of the combat load from American forces to the Iraqi and Afghan armies depends on four things.
First, United States military and civilian leadership must recognize that resources to support this major shift in strategy have to be re-routed from our regular forces. Left to themselves, the military services will inevitably neglect advisory efforts to sustain conventional forces. It took presidential direction to Vietnamize the war in Southeast Asia, and it will take a similar push to successfully “Iraqify” this war.
Second, shifting the burden from our forces to Iraqi and Afghan troops will call for close coordination between our civilian leadership and commanders in the field. Even as American combat forces draw down in favor of adviser-supported local armies, American combat support in the form of firepower, intelligence and logistics will continue to be crucial, possibly to the tune of tens of thousands of Americans in the combat zone. Politically, that may be a tough sell at home, but the success we’re finally seeing will falter without a continued American presence.
Third, the United States’ success depends on the willingness of the Iraqi and Afghan armies to fight with tenacity and skill. Soldiers of both countries are good fighters when well led. But we’ll let them down if we don’t send more and larger teams to embed with locals.
Finally, the American people must continue to be patient. In the 20th century, the average counterinsurgency campaign took nine years. The campaigns in Iraq and Afghanistan are likely to run longer, and other commitments loom in this protracted struggle against Al Qaeda and its imitators. Bitter experience has long recognized that only local armies can ultimately prevail in counterinsurgency operations.
For the United States, helping our friends defend themselves will be critical for victory in the long war, and improving our adviser capacity will be the foundation of a long-term strategy.

Iran Top Threat To Iraq, U.S. Says Focus on Al-Qaeda Now Diminishing By Karen DeYoung Washington Post Staff Writer Saturday, April 12, 2008; A01
Last week's violence in Basra and Baghdad has convinced the Bush administration that actions by Iran, and not al-Qaeda, are the primary threat inside Iraq, and has sparked a broad reassessment of policy in the region, according to senior U.S. officials.
Evidence of an increase in Iranian weapons, training and direction for the Shiite militias that battled U.S. and Iraqi security forces in those two cities has fixed new U.S. attention on what Defense Secretary Robert M. Gates yesterday called Tehran's "malign" influence, the officials said.
The intensified focus on Iran coincides with diminished emphasis on al-Qaeda in Iraq as the leading justification for an ongoing U.S. military presence in Iraq.
In congressional hearings this week, Army Gen. David H. Petraeus said the U.S. military has driven al-Qaeda from Baghdad, Anbar province and central Iraq, and he depicted the group as now largely concentrated in a reduced territory around the northern city of Mosul.
During their Washington visit, Petraeus, the top U.S. military commander in Iraq, and Ambassador Ryan C. Crocker barely mentioned al-Qaeda in Iraq but spoke extensively of Iran.
With "al-Qaeda in retreat and disarray" in Iraq, said one official who spoke on the condition of anonymity because he was not authorized to speak on the record, "we see other obstacles that were under the waterline more clearly. . . . The Iranian-armed militias are now the biggest threat to internal order."
Partly in response to advice from Petraeus and Crocker, the administration has initiated an interagency assessment of what is known about Iranian activities and intentions, how to combat them and how to capitalize on them. The review stems from an internal conclusion, following last week's fighting, that the administration lacked a comprehensive understanding and a sophisticated approach.
President Bush reiterated yesterday that if Iran continues to help militias in Iraq, "then we'll deal with them," saying in an interview with ABC News that "we're learning more about their habits and learning more about their routes" for infiltrating or sending equipment.
But he also reaffirmed that he has no desire to go to war with Tehran. Saying that his job is to "solve these issues diplomatically," Bush suggested heightened interest in reaching a solution with other countries. "You can't solve these problems unilaterally. You're going to need a multilateral forum."
Iran has long been seen as a spoiler in Iraq, with such strong ties to all of the major Shiite political and militia groups, including that of Prime Minister Nouri al-Maliki, that other Arab countries have begun to regard Iraq as almost a client state of Iran.
The recent fighting in Basra, which began when Maliki launched a military offensive against the Mahdi Army militia of Shiite cleric Moqtada al-Sadr, revealed a threat and an opportunity, officials said.
U.S. military officials said that much of the plentiful, high quality weaponry the militia used in Basra and in rocket attacks against the Green Zone in Baghdad, where the U.S. Embassy and much of the Iraqi government are located, was recently manufactured in Iran. At the same time, the militia's improved targeting and tactics indicated stepped-up Iranian training.
Interrogations of four leaders of Iran's Revolutionary Guard Corps Quds Force captured in Iraq in December 2006 and January 2007 have also bolstered U.S. conclusions that portions of Sadr's militia are directed from Tehran.
Despite earlier indications that Iranian backing for Iraqi armed groups and the flow of Iranian arms have waned, Adm. Michael Mullen, chairman of the Joint Chiefs of Staff, said yesterday that "this action in Basra was very convincing that indeed they haven't." Basra "gave us much more insight into their involvement in many activities."
Gates, who appeared with Mullen at a Pentagon news conference, said of Iran: "We are going to be as aggressive as we possibly can be inside Iraq in trying to counter their efforts." Iraqi security operations in Basra, he said, have been "a real eye-opener" for Maliki's government.
Petraeus told Congress that Maliki had launched the offensive hastily and with inadequate preparation, leading to a standoff and the need to call in U.S. air support. During the first days of the Basra operation, U.S. officials were sharply critical of Maliki's timing and performance; some worried that the attack against Sadr forces was less an offensive against what he called "criminals" in Basra than it was an attempt to win political advantage over a rival Shiite group before upcoming elections.
Iran's brokering of a tentative cease-fire among Shiite political groups and the militia in Tehran added to U.S. consternation.
"The importance of Iranian influence in facilitating the discussion between different political factions was of significant importance," Petraeus told Pentagon reporters yesterday. Administration officials worried that Iran appeared in control of events in Iraq, while the United States seemed weak and uninformed.
But more recently, U.S. officials have seen a possible advantage in the situation. Maliki's willingness to go after fellow Shiites attracted support from other political groups in Iraq, including Sunnis and Kurds, that have long been suspicious of his sectarian leanings. It also gave Washington a talking point to use with Sunni Arab governments in the region that have shunned him. "It's an opportunity to make him look better inside Iraq and to make a better argument to the Arabs," an official said.
The administration has long tried in vain to build Arab diplomatic and economic support for the Iraqi government. But the Arabs, led by Saudi Arabia, consider Shiite Iran a competitor for regional dominance and have rejected Maliki as "a stooge for Tehran," as one U.S. official called him.
"The Saudis appear to feel that the current Iraqi government is pretty much in thrall to Iran," said a State Department official involved in Middle East policy. The administration's hope, "in the wake of Maliki's decisions on Basra," the official said, "is that the Saudis will take a step back and take another look."
In a news conference Thursday, Crocker dismissed Arab concerns about a recent visit to Baghdad by Iranian President Mahmoud Ahmadinejad. "It's not the fact of the Ahmadinejad visit, but the absence of visits by other neighbors that it's important to focus on. There hasn't been a single visit, even by an Arab cabinet minister, to Baghdad. As Iraq grapples with the challenges Iran is posing, it could certainly do with some Arab support."
After consultations with Crocker and Petraeus this week, Bush cut short their Washington visit and dispatched them to Riyadh. During a luncheon at The Washington Post, Crocker said that at a White House meeting Thursday morning, they "reviewed where we are in Iraq."
The message to the Saudis, he said, "is going to be . . . it is time, more than time, for the Arab states to step forward and engage constructively with Iraq. Get their embassies open, get ambassadors on the ground, consider visits, implement debt relief, treat Iraq like the country it is, which is a central part of the Arab world."

The Wall Street Journal April 11, 2008 By Daniel Henninger The Airline Bomb Plot Barack Obama, Hillary Clinton and John McCain brought their presidential campaigns to the Petraeus-Crocker hearings on Iraq this week. An Iraq-based reporter appearing on one of the cable networks in the evening said the hearings struck him as oddly decoupled from the daily reality of war for the Iraqi people and U.S. troops there. Yup, never hurts to pinch yourself hard on entering presidential campaign space right now.
The three candidates addressed Gen. David Petraeus in tones of high gravitas equal to the thin altitude of the American presidency. Sen. Obama colloquied with Gen. Petraeus about the status of al Qaeda in Iraq – asking whether the terrorist organization could "reconstitute itself" and said that he was looking for "an endpoint."

Here's another hypothetical: Would this conversation be different today if in August 2006 seven airliners had taken off from Terminal 3 at Heathrow Airport, bound for the U.S. and Canada and each carrying about 250 passengers, and then blew up over the Atlantic Ocean?
It is a hypothetical because, instead of the explosions, British prosecutors this week presented their case against eight Muslim men arrested in August 2006 and charged with conspiring to board and blow up those planes.
The details emerging from that case are quite remarkable and will be summarized shortly. Pause to reflect on the ebb and flow of public debate that has occurred over how free societies should order themselves after two airliners full of passengers knocked down the World Trade Center Towers on Sept. 11 in 2001.
The view that 9/11 "changed everything" did not hold up under the weight of our politics. Divisions re-emerged between Democrats and Republicans, in office and on the streets. These fights reignited over the Patriot Act, Guantanamo and the warrantless wiretap bill (or "FISA" revision). These arguers stopped to stare momentarily at their televisions when Islamic terrorists committed mass murder in the 2004 Madrid train bombing and the 2005 London subway bombing.
One sometimes gets the feeling that our policy debates over national security and the journalism that travels with them float, as it were, at 30,000 feet above the reality of the threat on the ground. A novelist or filmmaker, alert to the personal demons that drive modern terror, would with fiction better clarify what is at stake. Start with the details of the eight defendants now on trial in England.
The names of the accused plotters, all men in their 20s, are Abdullah Ahmed Ali, Assad Sarwar, Tanvir Hussain, Mohammed Gulzar, Ibrahim Savant, Arafat Khan, Waheed Zaman and Umar Islam. They lived around London, in Walthamstow, Leyton, Plaistow and Barking. Most are Pakistanis.
Abdullah Ahmed Ali was caught on a wiretap telling his wife that he wished to bring his baby son along on the suicide mission. She resists. His suicide video, intended to become public after the planes blew up and shown at trial, promises "floods of martyr operations against you" and "your people's body parts decorating the streets."
Waheed Zaman studied biomedical science at London Metropolitan University. In his video Zaman says, "I have been educated to a high standard. I could have lived a life of ease but instead chose to fight for the sake of Allah's Deen [religion]."
Umar Islam mocks complacent Brits: "Most of you too busy, you know, watching Home and Away and EastEnders, complaining about the World Cup, drinking your alcohol." This would be fascinating as one nut's reason for murder. It is instead the basis for an ideology to justify blowing up thousands.
The prosecution said a computer memory stick on one of the men at his arrest listed the targeted flights. They were: United Airlines Flight 931 to San Francisco; UA959 to Chicago; UA925 to Washington; Air Canada 849 to Toronto; AC865 to Montreal; American Airlines 131 to New York and AA91 to Chicago. The first flight would depart at 2:15 p.m., the last at 4:50 p.m., allowing all to be aloft and out of U.S. or British airspace when they fell.
The private intelligence-analysis agency, Stratfor, concludes from the trial that "al Qaeda remains fixated on aircraft as targets and, in spite of changes in security procedures since 9/11, aircraft remain vulnerable to attack."
The men planned to take the bomb pieces onboard for assembly: empty plastic bottles, a sugary drink powder, hydrogen peroxide and other materials to be detonated with the flash on disposable cameras.
The arrests of the men, who say they are innocent, were the result of broad and prolonged surveillance. For months, the suspects were bugged, photographed and wiretapped.
Here in the U.S., our politics has spent much of the year unable to vote into law the wiretap bill, which is bogged down, incredibly, over giving retrospective legal immunity to telecom companies that helped the government monitor calls originating overseas. Even granting there are Fourth Amendment issues in play here, how is it that Speaker Nancy Pelosi, Hillary Clinton and Barack Obama cannot at least say that class-action lawsuits against these companies are simply wrong right now?
Philip Bobbitt, author of the just released and thought-provoking book, "Terror and Consent," has written that court warrants are "a useful standard for surveillance designed to prove guilt, not to learn the identity of people who may be planning atrocities." Planning atrocities is precisely the point.
"Atrocity" is a cruel and ugly word, but it has come to define the common parameters of the world we inhabit. It is entertaining to watch the candidates trying to convince the American people of their ability to be presidential. It would be more than nice to know, before one of them turns into a real president this November, what they will do – or more importantly, will never do – to stop what those eight jihadists sitting in the high-security Woolwich Crown Court in London planned for seven America-bound airliners over the Atlantic Ocean.
